Charles Leski Auctions Pty Ltd (herein referred to as "CLA") is committed to doing everything possible to ensure you are trading in a secure environment. To facilitate this, all CLA transactions are encrypted using the Secure Socket Layer system. Your online transaction will be encrypted and sent to the CLA accounts office where it will be processed. You are informed of the success or failure of your transaction, and CLA is given an authorisation and the order details (products, options, delivery address). If there is a hardware or software failure at any stage during the submission of details then the order is cancelled and no money is debited from your account.

Privacy
CLA takes your privacy seriously. The information we collect about you is only used to process orders and to provide better customer service.

What information do we collect?
We need to know you name, e-mail address, mailing address, credit card number, and expiry date for credit card authorisation for delivery of an order and to resolve any problems.

Who has access to the information collected?
Your credit card number and address information (for delivery) is available to the staff member who fulfils your order. Your email address will be retained for problem resolution.

Credit Card Payments

Auction Payments (Auction Lots)
Use of Visa, Mastercard & Bankcard will attract a 1% fee. American Express cards attracts a 2.5% fee.
Other Payments
For all other payments no surcharge will apply.

Terms & Conditions

1) You agree that all of the information you have provided to CLA in relation to the transaction which is the subject of the transaction form is complete and correct, including, without limitation, information provided by you in relation to your credit card details. 			  
2) You warrant CLA that you are fully authorised to use the credit card details for the purpose of online transactions.

3) CLA is under no obligation to provide the products ordered to you if CLA has any reason to suspect that you are not so authorised to use those credit details or your credit card provider has advised CLA that it will not honour your credit card details in this regard. CLA has no obligation to provide products to you until your credit card provider has authorised the transaction.

4) You must not use this service to engage in any misleading or deceptive conduct or fraud of any kind. You warrant to CLA that your credit card is within its validity date and is not listed on any warning bulletin held by any bank or credit card provider.

5) In using this service, you must comply with any applicable law, rule, regulation, standard or code of practice which relates to it.

6) You indemnify CLA, its employees, contractors and agents against any loss, costs or damage that they may suffer as a result of your use of this service or as a result of your breach of any of these terms and conditions.

7) CLA does not warrant that this service will be available for use at all times or at any particular time and may without notice suspend access to this service for any reason.

8) While CLA will use all reasonable endeavours to ensure the security of your information as described above, CLA does not warrant that the information will not be accessed by other parties.

9) To the extent permitted by law, CLA is not liable to you or anyone claiming through you for any loss or damage sustained or incurred by you, your employees, contractors or agents or any third party arising in any way in connection with this service or the products. To the extent permitted by law, we exclude all implied warranties in relation to the products and this service. Should CLA be liable to you by virtue of any applicable law for any loss or damage suffered, sustained or incurred by you either in connection with this service or the products, total liability for any loss or damage, shall, to the extent permitted by law, be limited, at CLA option, to the cost of supplying again the goods or services in respect of which the damage was incurredor to providing, replacing or repairing those goods or providing those services again.

10) You agree that you will comply with any requirement of your credit card provider which may relate to the use of this online service, including without limitation , not exceeding any transaction limit on your credit card used for the transaction. You must provide CLA with any off-line verification of your identity, your right to use the credit card and the details of the transaction as may be required by CLA from time to time.
